Terms of Service

Who we are

TutorPal (operated by Omar Soto) provides the TutorPal website and app. There is no company entity (no LLC or corporation). “We,” “us,” and “TutorPal” mean Omar Soto doing business as TutorPal.

Eligibility

You must be a parent or legal guardian, 18 years or older, to create an account, start a trial, or subscribe. Children use TutorPal only under that parent account. You represent that you have authority to consent for each child profile you add.

Account responsibility

You are responsible for the household account, the 4-digit parent PIN, and anyone who uses the child profiles. Keep the PIN away from young children so they cannot change billing or profiles. If you use optional Clerk sign-in, you must keep that login secure. You agree that information you provide (such as a first name for a child) is accurate enough for tutoring.

Subscription, trial, and auto-renewal

TutorPal Family is $14 per month or $119 per year (U.S. dollars), for 1 to 3 child profiles. We offer a 7-day free trial. Starting the trial requires a payment card. We do not charge the trial days; after the trial, the subscription auto-renews at the then-current Family price unless you cancel.

Payments are processed by Stripe. We do not store your full card number. Billing is handled in Stripe Checkout and the Stripe customer portal. By starting a trial or paying, you authorize recurring charges until you cancel.

Cancellation and refunds

You may cancel at any time in the parent area using Cancel or manage, which opens the Stripe customer portal. After you cancel, access continues until the end of the current paid period or trial (for example, the date shown as “access until”). We do not give partial refunds for unused days unless a law requires us to. If a charge was a clear error, email us and we will look at it in good faith.

Acceptable use

TutorPal is for family homework help, not for cheating services, scraping, or harming others. You agree not to:

• Upload photos of faces, IDs, or anything other than a homework page when using Foto.
• Try to break, overload, or reverse-engineer the service.
• Use the tutor to produce work you will turn in as the child’s unaided work when a school forbids that.
• Harass, abuse, or send illegal content.

AI disclaimer

TutorPal uses artificial intelligence. The tutor can be wrong, incomplete, or uneven. It is not a teacher of record, not a school, and not a substitute for a licensed educator, clinician, or your judgment. Parental supervision is recommended. Check important answers, especially grades and safety topics. We do not warrant that hints will match a particular curriculum.

Intellectual property

TutorPal, the tutor faces, and our materials are owned by Omar Soto / TutorPal or our licensors. You keep rights to homework photos and messages you submit; you grant us a limited license to process them only to provide the service (including sending them to our processors as described in the Privacy Policy).

Termination

We may suspend or end access if you violate these Terms, if payment fails, or if we shut down the service. You may stop using TutorPal and cancel as described above. After access ends, stored chat and profiles may be deleted as described in the Privacy Policy.

Disclaimers

THE SERVICE IS PROVIDED “AS IS.” TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not promise uninterrupted service or error-free AI replies.

Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, TutorPal (operated by Omar Soto) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST GRADES, SCHOOL OUTCOMES, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR TUTORPAL IN THE 12 MONTHS BEFORE THE CLAIM, OR $50 IF YOU HAVE NOT PAID. Some states do not allow certain limits; in those states our liability is limited to the maximum permitted.

Governing law

These Terms are governed by the State of Florida, United States, without regard to conflict-of-law rules, except where consumer law in your place of residence requires otherwise. Courts in that jurisdiction may hear disputes, subject to those same consumer-law rights.

Changes

We may update these Terms. We will change the effective date at the top of this page. Continued use after an update means you accept the new Terms, except where the law requires a different process. Material billing changes will be described in the parent area or by email when we have an address.
